This privacy policy aims to inform you about how Corporación Alken del Sur BJK S.A., located in Pérez Zeledón, 150 meters east of PZ Country Club, Cooperativa neighborhood, San Isidro del General, Costa Rica («ALKEN»), and its subsidiaries (collectively, “Alken,” “we,” “our,” or “us”) collect, store, use, and process your personal data (“personal data”) provided through any digital platform operated by Alken (the “digital platforms”).

1. What types of personal data do we collect?

Personal data is collected solely for the purposes stated in Section 3 below and whenever you participate in any of the events, activities, or services offered through our Digital Platforms.
The type and amount of information collected for the aforementioned events and services may be updated and vary depending on ALKEN’s activities.

Subject to applicable legal requirements, we may use various technologies to collect and provide information about how you access and use our Digital Platforms. We may also use demographic information (such as your age, gender, and areas of interest, if available) about users of our Digital Platforms, which we may obtain from third parties or through the social networks you use («Usage Information»). Usage Information may include the pages you viewed, when you viewed them, what beverage information or other content you accessed or provided, in what language, including demographic information about you, and the pages you viewed before accessing the current page, among others.

2. For what purposes do we use your personal data?

The type of information we collect depends on how you interact with us. We collect your personal data for the following purposes:

The information may be used by the company for business purposes, including maintaining a history of my consumption patterns, sending me commercial information, advertising, and serving as a contact for informational purposes, statistical analysis, tracking my dealings with the company, transferring such data internationally, among others. This information could be related to the brands I purchase from ALKEN, as well as brands of products I have not purchased.
Responding to your service requests or executing a contract: When you register or subscribe to our digital platforms (mobile applications, websites, social media, etc.), your personal data is used to provide the functionalities and services you have subscribed to and to offer you the advantages and privileges derived from your registration (for example, receiving communications you selected at the time of registration, being invited to events, participating in contests, etc.).
Sending you operational or administrative communications: (for example, a confirmation email when you sign up [or cancel your subscription] to a service or feature), as well as various notifications regarding the services (for example, notifications about updates to our privacy notices, service interruptions, changes affecting our online services or IT support policies, notifications about other related changes, etc.).
Allowing us to send you marketing communications, provided you have given us your consent.
In addition to the purpose for which you have provided us with your personal data, we may also request your consent (e.g., by checking a box) to use your personal data for a different activity or service from the primary activity or service of your request. For example, if you register for a contest or any other promotional activity, we may also invite you to subscribe to newsletters or alerts sent by our digital platforms where the promotional activity is organized or by other websites. If you agree to receive our targeted advertising, emails, and SMS messages, we will use your personal data for this purpose.
To improve our service:
- As long as we have your consent (where required), we may combine, update, or aggregate your personal data collected through our digital platforms with other data received from third parties or external sources. For example, we may combine purely demographic or survey data (such as age, gender, family information, other interests, etc.) unrelated to any of your personal data with personal data collected through our offerings (e.g., when you register an account).
- We may use this combined data and/or the aforementioned demographic data for our demographic and marketing studies to continuously improve, personalize, and tailor the products and services we offer to better meet your needs. Some of the tools we use may involve automated decision-making processes as permitted by relevant legislation.
- We will ensure that your personal data remains accurate and up to date or is supplemented with any additional information you have provided. We will also strive to avoid duplication in our database by verifying each of your interactions with us and checking whether your personal data remains accurate or needs to be supplemented or updated.
- We may analyze your activities and browsing habits on our digital platforms to better understand your preferences and interests and tailor our communications to your preferences unless you object under the conditions outlined in this Policy.

3. What happens if you refuse to provide us with your personal data?

If you refuse to provide us with the personal data we request, you may not be able to participate in certain activities, enjoy certain personalized functionalities, or access the special digital services we offer. However, you are not required to provide us with your personal data to browse our digital platforms and learn about ALKEN and our products. In any case, we will always indicate which personal data is necessary to access a service.

4. Why and to whom do we transmit your personal data?

a. To companies within Corporación Alken del Sur BJK S.A.: For the purposes mentioned in section 2, ALKEN may share your personal data within the Alken Economic Group, including Dimond, Quimera, Seren, Transporte Sobre Ruedas, Residencial Sulit, and Residencial Vima.

Various officials, employees, representatives, and advisors (both external and internal) of ALKEN will have access to the information for the same purposes. Additionally, providing this information is optional. However, if I refuse to provide it, the Company may deny me certain services.

b. To third parties: We may transmit your personal data to third parties, but only in the following cases:

• For marketing purposes, provided we have your consent.
• For assistance purposes: We may engage service providers, agents, or contractors to provide support and maintenance services for our digital platforms and to help manage these platforms or the various programs, promotions, and features they include. These third parties commit to providing the same level of security for your personal data as ALKEN, and when required by law, these commitments will be formalized in a written contract.
• For joint and co-sponsored promotional programs:
When we conduct joint or co-sponsored promotional activities on our digital platforms in collaboration with other companies or any other trusted third party, and in the context of these activities, we collect and process your personal data, we may share it, provided we have obtained your consent when required by law. If your personal data is collected by another company other than ALKEN (or transmitted to them) as part of this promotional activity, we will inform you at the time of data collection.
• By legal or security requirements: We may also transmit your personal data if required by law or if we believe in good faith that such transmission is reasonably necessary to comply with legal proceedings, respond to claims, or protect the security or rights of ALKEN, its customers, or the public.
• In the event of a merger, acquisition, or sale of ALKEN’s assets:
If ALKEN is fully or partially acquired by another company, or in case of a sale or transfer of all or part of its business assets, the buyer will have access to certain information that may include personal data, in accordance with applicable laws. Additionally, some of your personal data may be transferred as part of a restructuring, insolvency procedure, or any similar situation, if permitted by and in compliance with applicable laws.

5. How long do we retain your personal data?

We will store your personal data in our databases while your account remains active, for the duration specified in the contract signed with you, or as long as necessary to provide the services you require, respond to your inquiries, resolve issues, or offer new and improved services.

We may also retain your personal data in accordance with our internal retention procedures, to comply with legal and regulatory obligations, resolve disputes, and enforce our contracts. However, once ten years have passed since the date of the recorded events, unless a special regulation specifies otherwise, the data will be deleted from our databases. If further retention is necessary beyond the stipulated period, the data will be dissociated from its owner.

Therefore, we may retain your personal data even after you stop using ALKEN’s services or digital platforms, in compliance with legal requirements.

6. How do we protect your personal data?

ALKEN will take all necessary technical and organizational measures to protect the privacy and security of your personal data collected through our digital platforms. These measures include, among others:
(i) storing your personal data in secure operating environments that are not accessible to the public, but only to authorized ALKEN personnel, agents, and contractors, and
(ii) verifying the identity of registered users before granting access to their personal data.

7. What are your rights?

a. You have the right to access your personal data.
b. You may request to rectify, update, or request the cancellation or deletion of your personal data if it is inaccurate, incomplete, outdated, or was collected without your authorization.
c. If your personal data has been processed with your consent, you have the right to withdraw such consent at any time without affecting the consent given before its withdrawal.
d. You may request the deletion of your personal data when: (i) your personal data is no longer necessary for the purpose for which it was processed, (ii) you have withdrawn your consent for processing based solely on such consent, (iii) you have objected to the processing of the data, (iv) the processing of your personal data is unlawful, (v) the personal data must be deleted to comply with a legal obligation applicable to ALKEN. ALKEN will take the necessary reasonable steps to inform other entities within the Group of such deletion.
e. You may request the restriction of processing: (i) if you dispute the accuracy of your personal data to allow us to verify such accuracy, (ii) if you wish to restrict your personal data instead of deleting it in case of unlawful processing, (iii) if you want ALKEN to retain your personal data because you need it to defend yourself in a legal proceeding, (iv) if you have objected to the processing but ALKEN is conducting an investigation to determine whether it has legitimate grounds to proceed with such processing that may override your rights.
f. You may always choose not to provide us with your personal data, in which case your activities and the functionalities we can provide may be limited.
g. You have the right to object to the processing of your personal data, including for marketing purposes based on profiling, or if the data processing is based on ALKEN’s legitimate interest.

8. How do we handle children’s personal data?

Our website is not intended for minors, as they do not have the legal age required to enter into professional service contracts («minors»), and we do not knowingly collect any personal data from minors. The user must be at least eighteen years old to create an account and participate in activities and transactions on our digital platforms. If we become aware or are informed that a minor has submitted their personal data through our digital platforms, we will proceed with its deletion.

By accepting this document, I acknowledge that I have been informed that Corporación Alken del Sur BJK S.A., legal entity ID 3-101778461 (the «Company»), manages and safeguards a personal database (the «Database») where the information provided at this time, as well as any other information provided during the business relationship I have or may have with said company (the «Information»), is stored.

I have the right to request access, rectification, updating, and deletion of the Information under the terms indicated in the «Law on the Protection of Individuals Regarding the Processing of Their Personal Data» and its regulations. Furthermore, I declare that I have been informed that the Company and its affiliates are responsible for the Database and that I am aware of the address of their offices, as indicated above.

I have been informed that I can exercise all the aforementioned rights by expressing my request via email to recepcion@grupoalkencr.com. Additionally, I acknowledge that providing this information does not establish any employment relationship with the Company or modify any existing employment relationship.
